I. General Terms and Conditions

§ 1 Basic Provisions

(1) The following terms and conditions apply to all contracts concluded between you and us, Lugash Kugendran, via the website www.mooglisbazaar.com. Unless expressly agreed otherwise, we object to the inclusion of any of your own terms and conditions.

(2) A consumer within the meaning of these provisions is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity. An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or independent professional activity.

§ 2 Conclusion of the contract

(1) The subject of the contract is the sale of goods.

(2) By publishing a product on our website, we make you a binding offer to conclude a contract via the online shopping cart system under the conditions stated in the respective item description.

(3) The contract is concluded via our online shopping cart system as follows:
The desired products are placed in the "shopping cart". You can access the "shopping cart" at any time and make changes there using the button in the navigation bar. After you have accessed the "Checkout" page and entered your personal data as well as the payment and shipping information, you will be shown an order overview.

If you select an instant payment system (e.g. PayPal, PayPal Express, Amazon Pay, Sofortüberweisung), you will either be redirected to the order overview in our online shop or to the website of the respective payment provider. You make the relevant entries on the instant payment provider's website. After completing the payment process, the order overview will be displayed again either on their website or after you return to our shop.

Before you submit the order, you have the opportunity to check all the details in the order overview and change them if necessary (also via the "back" function of your browser) or cancel the order process. By clicking on the "buy" button (or a similarly named button) you submit a binding offer and the contract is legally concluded.

(4) If you send us a request to create an offer, this is non-binding for you. We will then send you a binding offer in text form (e.g. by email), which you can accept within 5 days, unless another deadline is specified.

(5) Order processing and transmission of all contract-relevant information takes place by email, partly automatically. Therefore, make sure that the email address you provide is correct and that receipt of the emails is technically guaranteed, in particular that they are not blocked by spam filters.

§ 3 Right of retention, retention of title

(1) You can only assert a right of retention if the claims arise from the same contractual relationship.

(2) The goods remain our property until full payment has been made.

§ 4 Warranty

(1) The statutory liability for defects applies.

(2) We ask you as a consumer to check the goods immediately upon delivery for completeness, obvious defects or transport damage and to inform us and the shipping service provider of any complaints as soon as possible. Your statutory warranty claims remain unaffected, even if you do not comply with this request.

§ 5 Choice of Law

(1) German law applies. This choice of law applies to consumers only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which the consumer has his or her habitual residence (favorability principle).

(2) The UN Convention on Contracts for the International Sale of Goods is expressly excluded.

2. Information on the conclusion of the contract
The technical steps, the conclusion of the contract and the correction options are governed by the provisions in the section “Conclusion of the contract” in our General Terms and Conditions (Part I).

3. Contract language, storage of the contract text

3.1 The contract language is German.

3.2. We do not save the complete contract text. Before submitting the order via the online shopping cart system, you can print out the contract data using the print function of your browser or save it electronically. After we receive your order, we will send you the order data, the legally required information for distance selling contracts and the general terms and conditions by email.

3.3. If you request an offer outside of the online shopping cart system, you will receive all contract data in a binding offer in text form, for example by email, which you can print out or save electronically.

4. Essential characteristics of the goods or services
The essential characteristics of the goods or services are listed in the respective offer.

5. Prices and payment terms

5.1 The prices stated in the offers as well as the shipping costs are total prices that include all price components including taxes.

5.2. Shipping costs are not included in the purchase price and are shown separately during the ordering process. They must be paid additionally, unless free shipping has been agreed.

5.3. If payment is made from a non-EU country, any transfer fees or exchange rate costs must be borne by you if the delivery is made to an EU member state.

5.4. The available payment methods are listed on our website or in the respective offer.

5.5 Unless otherwise stated, payment claims are due immediately after conclusion of the contract.

6. Delivery conditions

6.1 The delivery conditions, delivery date and possible delivery restrictions can be found under the corresponding button on our website or in the respective offer.

6.2. If you are a consumer, the risk of accidental loss or damage to the goods during shipping only passes to you when the goods are handed over to you, regardless of whether the shipment is insured or not. This does not apply if you independently commission a transport company that was not named by us.

7. Statutory liability for defects
The provisions under “Warranty” in our General Terms and Conditions (Part I) apply to liability for defects.
