Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to the following contracts:
- For the delivery of goods that have been individually manufactured according to the customer's wishes or are clearly tailored to his personal needs.
- For goods that can spoil quickly or whose expiration date is soon approaching.
- For the delivery of alcoholic beverages, the price of which was agreed upon conclusion of the contract, but which are delivered no earlier than 30 days after conclusion of the contract and whose value is subject to market fluctuations over which the seller has no influence.
- For the delivery of items abroad.
- For the delivery of newspapers, magazines or illustrated magazines, unless it is a subscription.
Premature expiration of the right of withdrawal
The right of withdrawal expires prematurely in the following cases:
- In the case of sealed goods which are not suitable for return for reasons of health protection or hygiene if the seal has been removed after delivery.
- For goods which, due to their nature, have been inseparably mixed with other goods after delivery.
- In the case of sound or video recordings or computer software delivered in a sealed package, if the seal has been removed after delivery.
